Terms of Use

1. Definitions

Platform: The website videos-review.com.

User: Any person registered on the Platform. Users include:

  • Client: An individual publishing reviews of goods/services.
  • Company: A representative of a business responding to or posting reviews.

Content: Any material (video, photo, text, or other media) posted by a User.

Review: A User’s opinion based on personal experience.

2. Rules of Platform Use

2.1. By posting Content, the User represents and warrants that they hold all necessary rights (including copyrights) to such Content and that its publication does not violate third-party rights.

2.2. The publication of knowingly false, misleading, or commissioned (“fake”) Reviews is strictly prohibited. The Platform reserves the right to remove such Content upon receipt of an appropriate notice or at its own discretion.

2.3. The use of profanity, defamatory statements, insults, threats, or the publication of third-party personal data without consent is prohibited and may constitute a violation of applicable data protection laws (including the GDPR).

2.4. Posting advertisements, spam, or commercial promotions is prohibited unless expressly authorized by the Platform.

2.5. Users are responsible for maintaining the confidentiality of their account credentials and are fully responsible for activities conducted through their account.

2.6. Users must be at least 16 years of age (or the age required by local law) to use the Platform.

3. Intellectual Property

3.1. The User retains all ownership rights to their Content.

3.2. By uploading Content, the User grants the Platform a royalty-free, non-exclusive, worldwide, transferable, and sublicensable license to use, reproduce, modify, distribute, and publicly display such Content solely for the purposes of operating, promoting, and improving the Platform.

3.3. This license remains valid until the Content is deleted from the Platform or the User’s account is terminated, except that residual copies may remain for technical or legal compliance purposes.

3.4. The Platform’s own trademarks, trade names, and logos remain its exclusive property and may not be used by Users without prior written consent.

4. Moderation and Disputes

4.1. The Platform reserves the right, but not the obligation, to monitor, review, and moderate all Content.

4.2. The Platform is not liable for User-generated Content unless and until it receives formal notice of its unlawful nature.

4.3. Upon receiving notice of a violation, the Platform will act promptly to remove or restrict access to the offending Content.

4.4. The Platform may suspend or permanently terminate User accounts in case of repeated or material violations of these Terms.

4.5. Users may report violations via the complaint form available on the Platform.

5. Limitation of Liability

5.1. The Platform serves solely as an information intermediary and does not verify the accuracy or truthfulness of User Content.

5.2. The Platform disclaims liability for any damages arising from the use of or reliance upon Content posted by Users.

5.3. Nothing in these Terms shall exclude or limit the Platform’s liability in cases of willful misconduct, gross negligence, or statutory liability where exclusion would be unlawful.

5.4. To the fullest extent permitted by law, the Platform’s total liability to any User shall not exceed the greater of (a) the amount paid by the User (if any) for access to the Platform, or (b) $100 USD.

6. Indemnification

Users agree to indemnify, defend, and hold harmless the Platform, its owners, officers, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorney fees) arising from or related to:

  • Their Content,
  • Violation of these Terms,
  • Infringement of third-party rights, or
  • Violation of any applicable law.

7. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law principles.

Disputes shall be resolved as follows:

a) Consumer Users: Disputes shall be resolved under applicable consumer protection law in the jurisdiction of the User’s residence.

b) Business Users: Disputes shall be resolved exclusively in the courts located at the Platform’s principal place of business.

8. Dispute Resolution Procedure

8.1. Users must first attempt to resolve any disputes by contacting the Platform at support@videos-review.com within 30 days of the event giving rise to the claim.

8.2. If the dispute cannot be resolved through negotiation, the parties may pursue resolution in the competent court as provided in Section 7.

9. Amendments

The Platform may update or modify these Terms from time to time. Users will be notified of material changes via email or notice on the Platform. Continued use of the Platform after such notice constitutes acceptance of the revised Terms.

10. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.

11. Entire Agreement

These Terms, together with the Platform’s Privacy Policy [link], constitute the entire agreement between the User and the Platform regarding use of the services and supersede all prior agreements or understandings.
